Right of First Refusal of Yoshimasa Tsuchiya Sculpture

 

Artox hereby grants Collector a right of first refusal on the Artwork or any portion of the Artwork in accordance with the terms below (“Right of First Refusal”).
 
1. If during ONE(1) Year from the date of this Agreement, Artox receives a right of first refusal should the purchase desire to resell the Artwork.
 
2. The Collector agrees to notify Artox of their intention to resell the Artwork via e-mail, and allow THIRTY(30) days good faith negotiation for a buyback price and a process of the transaction which will be mutually agreed by email (cs@artoxgroup.com).  If Artox does not reply within the response period, upon the completion of such Response Period, the collector shall be permitted to freely resell the Artwork.
 
3. Collector shall ensures that the party acquiring the Artwork gives Artox equivalent rights to the Artwork as those set forth in this session, and, provide, further that the Collector agrees to inform the Artox of the new purchaser and their contact details by email.

Artox has the right to unilaterally cancel your order under the following circumstances, and if you have already made a payment, Artox will refund your payment through your original payment platform and without incurring any liabilities:

 

l   We reserve the right to final order confirmation

 

l   The use of robots, software plug-ins, automated equipment and other similar technologies to invade into the Artox system to create accounts, make orders or make payments, which affect the purchasing activities of other users or the normal orderly sales of Artox products. In case of any such situation, Artox will cancel the order, and may also permanently close your account with Artox

 

l   The purpose of purchasing the product is for resale

 

l   The payment is not successfully completed within the specified time

 

l   Artox finds that one person is making multiple purchases of the Product. (For example, use of the same debit card or third-party payment account by multiple purchasers, multiple orders shipped to the same address, etc.)

NO REFUNDS WILL BE GIVEN ON ANY PURCHASES


|  Cancellation is not allowed once the order and payment have been confirmed/verified by us


|  All products must be checked after the received of the Product. Any damage claimed after 1 week of the received of the product will not be accepted


|  Valid damaged claim will be arranged by replacement or refund subject to the product availability


|  Artox Group Limited reserves the right to arrange replacement or refund. For replacement, customer will be responsible for paying his own shipping costs for returning the items

 

|  Some of the products are hand-made and the product details may vary depending on specific models


|  Due to continuous product improvement, we reserve the right to change product specifications or designs from time to time without notice


|  Pre-order items take 3-6 months for production. For some of the special items, please refer to our announcement on our website for the latest update


|  All packaging serves to protect the product from damage. It is not belonged to the part of the Product, we are not responsible for any damaged on the packaging


|  Fine scratches may remain on the surface. Please note that this is part of the product characteristics and is not subject to any replacement


|  Delivery Charges is not included in our prices. Any customs fees or import tax incurred during shipping, customer are responsible to those payment


|  We will not be responsible for delays caused by customs or postal or courier services

 

|  Artox Group Limited is not responsible for any lost or stolen packages confirmed to be delivered to the address entered for an order
